Welcome to The Toddler Kitchen (thetoddlerkitchen.com) (the "Site," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Site. By using the Site, you agree to be bound by these Terms and by our Privacy Policy, Disclosures and Disclaimer, which covers our data practices, cookie use, affiliate and sponsored content disclosures, and medical/nutrition disclaimer, and is incorporated into these Terms by reference. If you do not agree, please do not use the Site.
1. Acceptance of Terms
By accessing or using the Site, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, Disclosures and Disclaimer. We may update these Terms from time to time (see Section 9); continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
2. About the Site
The Toddler Kitchen provides recipes, meal ideas, feeding tips, and related content for parents and caregivers of babies, toddlers, and young children, created by Ali, a registered dietitian. The Site is intended for use by adults and is not directed at children under 13.
3. Your Use of Our Content
The content available on the Site — including recipes, text, photographs, videos, graphics, logos, and design (the "Content") — was created, developed, compiled, and arranged by us using our own methods, judgment, and professional expertise, and through the expenditure of substantial time and effort. The Site and the Content are proprietary and protected by these Terms (a binding agreement between you and us), by Canadian and other applicable copyright laws and treaties, and by other intellectual property laws, including protection as a compilation or collective work — see our Privacy Policy, Disclosures and Disclaimer for our copyright notice. We make the Content available for your personal, non-commercial use only.
You may not use, and may not authorize, enable, or assist any third party (including any automated tool, bot, script, or artificial intelligence or machine learning system) to use, the Site or the Content in any manner that:
(i) is a source of or substitute for the Site or the Content;
(ii) affects our ability to earn revenue in connection with the Site or the Content, including through advertising;
(iii) competes with the Site or the services we provide; or
(iv) reproduces, scrapes, crawls, mines, indexes, or otherwise extracts the Content for the purpose of training, developing, fine-tuning, or improving any artificial intelligence system, machine learning model, dataset, or similar technology, without our prior written consent.
These restrictions apply to any robot, spider, scraper, web crawler, data-mining tool, or other automated means, or any similar manual process, or any software used to access the Site. You further agree not to violate the restrictions in any robots.txt file or other robot exclusion headers on the Site, if any, and not to bypass, circumvent, or interfere with any rate limiting or other technical measures we use to control or restrict access to the Site.
You may share links to our Content and print a single copy of a recipe for personal, non-commercial use. You may not otherwise reproduce, republish, redistribute, sell, or use the Content for commercial purposes without our prior written permission — contact ali@thetoddlerkitchen.com to request permission.
4. Third-Party Advertising and Links
The Site displays advertising served through Mediavine and its advertising partners, and may link to third-party websites or services we don't own or control. We are not responsible for the content, practices, or accuracy of any third-party site, and your dealings with any third party are solely between you and them. 5. Disclaimer of Warranties
The Site and its Content are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that recipes or Content are free from errors. Use of any recipe or feeding suggestion is at your own risk, including as to allergen, choking, and food-safety considerations for your own child — see our medical/nutrition disclaimer in the Privacy Policy, Disclosures and Disclaimer page.
6. Limitation of Liability
To the fullest extent permitted by law, The Toddler Kitchen, its owner, and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, income, or profit, arising out of or related to your use of, or inability to use, the Site, even if we have been advised of the possibility of such damages.
7. Indemnification
You agree to indemnify and hold harmless The Toddler Kitchen and its owner from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site or your violation of these Terms.
8. Governing Law and Dispute Resolution
Governing Law. These Terms are governed by the laws of the Province of British Columbia and the laws of Canada applicable therein, without regard to conflict-of-law principles.
Agreement to Arbitrate. Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site that cannot be resolved informally will be resolved by binding arbitration, rather than in court, except that either party may bring an individual claim in small claims court. You and The Toddler Kitchen each waive the right to a jury trial and the right to participate in a class action or class arbitration. Before initiating arbitration, you agree to first contact us at ali@thetoddlerkitchen.com to attempt to resolve the dispute informally.
9. Consent to Data Collection and Use
By using the Site, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy, Disclosures and Disclaimer, including cookies and similar technologies used by us and our advertising and analytics partners (including Google Analytics and Mediavine).
10. Changes to These Terms
We may revise these Terms at any time by updating this page; the "Last Updated" date above will reflect material changes. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
11. Severability
If any provision of these Terms is found unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
12. Entire Agreement
These Terms, together with our Privacy Policy, Disclosures and Disclaimer, constitute the entire agreement between you and The Toddler Kitchen regarding your use of the Site.
